Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PropIntel platform operated by AQESTRA LLC (“AQESTRA,” “we,” “us,” or “our”) at app.propintel.co (“PropIntel” or the “Service”). By creating an account or using PropIntel, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

PropIntel is an AI-powered property intelligence platform that provides real estate investors with property data, analytics, deal scoring, and mapping tools. Property data is sourced from public government records and is provided for informational purposes only. PropIntel is not a licensed real estate brokerage, appraisal firm, title company, or law firm, and does not provide professional real estate, legal, tax, or financial advice.

2. Eligibility

You must be at least 18 years of age to use PropIntel. By creating an account, you represent that you are at least 18 years old and that the information you provide during registration is accurate and complete. You agree to keep your account information current.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• Each account is for a single individual. Sharing account credentials with others is prohibited.
• You must notify us immediately at legal@aqestra.com if you suspect unauthorized access to your account.

4. Subscription and Billing

4.1 Plans and Pricing

PropIntel offers multiple subscription tiers, each with specific feature limits and pricing as described on our pricing page at the time of purchase. We reserve the right to modify pricing with 30 days’ notice to existing subscribers.

4.2 Recurring Billing

Subscriptions are billed on a recurring monthly or annual basis through Stripe. By subscribing, you authorize us to charge your payment method on each billing cycle until you cancel.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until your billing period expires.

4.4 Refunds

We do not provide refunds for partial billing periods. If you cancel mid-cycle, you will not be charged for the next cycle, but no prorated refund will be issued for the remaining days of the current period.

4.5 Free Tier and Trials

We may offer free tiers or trial periods at our discretion. Free and trial access may be limited in features, data, or duration, and may be modified or discontinued at any time.

5. Acceptable Use

Your use of PropIntel is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of the Acceptable Use Policy constitutes a violation of these Terms.

6. Intellectual Property

6.1 Our Property

PropIntel, including its software, design, AI scoring algorithms, aggregated datasets, documentation, and branding, is the proprietary property of AQESTRA LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of the Service except as expressly permitted by these Terms.

6.2 AI-Generated Content

AI deal scores, analyses, and explanations generated by PropIntel are produced by our proprietary scoring pipeline and are owned by AQESTRA LLC. You are granted a limited, non-exclusive license to use AI-generated results for your own investment research purposes. You may not resell, redistribute, or publicly present AI-generated results as your own analysis.

6.3 Your Content

You retain ownership of content you create within PropIntel, including custom deal profiles, saved searches, property notes, and lists. You grant us a limited license to store, process, and display this content as necessary to provide the Service.

PropIntel’s AI deal scoring provides automated analysis of properties based on publicly available data and user-defined criteria. AI scores are algorithmic assessments, not professional opinions. They should be used as one input among many in your investment analysis, not as the sole basis for any purchasing decision. AI-generated scores and analyses may contain errors or reflect incomplete data.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AQESTRA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF PROPINTEL.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR ANY INVESTMENT DECISIONS, PROPERTY PURCHASES, OR FINANCIAL OUTCOMES BASED ON DATA OR ANALYSIS PROVIDED BY PROPINTEL.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA WILL BE ACCURATE OR COMPLETE.

11. Indemnification

You agree to indemnify, defend, and hold harmless AQESTRA LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or our Acceptable Use Policy. Upon termination, your right to access the Service ceases immediately. We will make reasonable efforts to notify you before or at the time of termination, except where we determine that immediate termination is necessary to protect the Service or other users.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of PropIntel shall be resolved exclusively in the state or federal courts located in Florida. You consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of PropIntel after changes take effect constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and AQESTRA LLC regarding your use of PropIntel and supersede any prior agreements.
